1. Acceptance of Terms

Welcome to BashWeather. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and BashWeather, operated by Bashar Sawaqed ("BashWeather", "we", "us", or "our"), governing your access to and use of the BashWeather progressive web application and related services (collectively, the "Service") available at bashweather.app.

By accessing or using the Service in any manner, including visiting, browsing, registering an account, or installing the Service as a Progressive Web App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, Cookie Policy, and Disclaimer, all of which are incorporated herein by reference.

If you do not agree to these Terms, you must immediately cease using the Service.

2. Eligibility

The Service is intended for users who are at least 13 years of age. By using the Service, you represent and warrant that:

• You are at least 13 years old;
• If you are between 13 and 18 years of age (or the age of majority in your jurisdiction), you have obtained verifiable parental or guardian consent to use the Service;
• You are not prohibited from using the Service under the laws of your country of residence or any other applicable jurisdiction;
• You are not subject to sanctions or on any prohibited persons list maintained by the United States, European Union, United Nations, or other applicable government authorities.

We reserve the right to terminate access for any user found to be under the minimum age or otherwise ineligible.

3. Your Account

BashWeather uses Google Sign-In (OAuth 2.0) for account creation and authentication. You do not create a separate BashWeather password; your account security is governed by your Google account credentials.

Your responsibilities:

• You are responsible for maintaining the security of your Google account, including enabling two-factor authentication.
• You must notify us immediately at privacy@bashweather.app if you become aware of any unauthorised use of your account.
• You are solely responsible for all activities that occur under your account.
• You may not share your account with any other person or create multiple accounts for abusive purposes.
• You may not use another person's account without their explicit authorisation.

We reserve the right to suspend or terminate accounts that violate these Terms or that are compromised, without prior notice where immediate action is necessary to protect the Service or other users.

4. Permitted Use & Restrictions

Subject to your compliance with these Terms, BashWeather grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal, non-commercial purposes.

You may NOT:

• Copy, reproduce, distribute, modify, create derivative works from, or publicly display any portion of the Service or its content without our express written permission;
• Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the Service;
• Use any automated system, bot, scraper, crawler, or data-mining tool to access the Service or extract data;
• Interfere with or disrupt the integrity or performance of the Service or its infrastructure;
• Attempt to gain unauthorised access to any systems, networks, or data associated with the Service;
• Transmit any viruses, malware, or other harmful code;
• Use the Service for any illegal purpose or in violation of any applicable law or regulation;
• Impersonate any person or entity or misrepresent your affiliation with any person or entity;
• Use the Service in any manner that could harm, disable, overburden, or impair it;
• Resell, sublicense, or commercialise any aspect of the Service without our prior written consent.

We reserve the right to investigate and take appropriate legal action against anyone who violates these restrictions, including reporting to law enforcement authorities.

5. Weather Data Accuracy Disclaimer

BashWeather expressly disclaims all liability for any loss, injury, damage, or adverse outcome arising from reliance on weather data provided through the Service. See our Disclaimer for full details.

6. Intellectual Property

The Service and all its original content, features, functionality, branding, trademarks, service marks, logos, interface designs, code, and documentation are the exclusive property of BashWeather (Bashar Sawaqed) and are protected by applicable intellectual property laws in the Hashemite Kingdom of Jordan and internationally, including copyright, trademark, and database rights.

The BashWeather name, logo, and the "BashWeather" mark are trademarks of Bashar Sawaqed. You may not use these marks without prior written permission.

What you may do: You may print or download content from the Service for your personal, non-commercial use, provided you do not modify it and you retain all copyright and proprietary notices.

Third-Party Content: Weather data is sourced from Open-Meteo and is subject to Open-Meteo's licensing terms. Map and geolocation data may be subject to additional third-party rights.

Feedback: If you submit feedback, suggestions, or ideas about the Service, you grant BashWeather a perpetual, royalty-free, worldwide licence to use, incorporate, and exploit such feedback without any obligation to you.

7. Third-Party Services

The Service integrates with and depends upon third-party services, including:

• Google LLC — for authentication (Google Sign-In) and analytics (Google Analytics 4)
• Open-Meteo — for weather forecast data
• Cloudflare, Inc. — for infrastructure, security, and API hosting

These third-party services have their own terms of service and privacy policies, which govern their respective services. BashWeather is not responsible for the content, policies, or practices of any third-party service. Your use of third-party services is at your own risk and subject to their respective terms.

The Service may contain links to external websites. We do not endorse and are not responsible for the content, accuracy, or practices of any external site.

8. Disclaimer of Warranties & Limitation of Liability

8.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BASHWEATHER DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION.

We do not warrant that: (a) the Service will meet your requirements; (b) the Service will be available at any particular time or location; (c) any errors or defects will be corrected; (d) the Service is free of viruses or other harmful components; or (e) any weather data provided is accurate or complete.

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BASHWEATHER AND ITS OPERATOR (BASHAR SAWAQED) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, PERSONAL INJURY, OR PROPERTY DAMAGE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR USD $10.00, WHICHEVER IS GREATER. SINCE THE SERVICE IS FREE, THIS AMOUNT WILL TYPICALLY BE USD $0.00.

9. Indemnification

You agree to defend, indemnify, and hold harmless BashWeather, its operator (Bashar Sawaqed), and any affiliated parties from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms;
• Your use of the Service in a manner not authorised by these Terms;
• Your violation of any third party's rights, including intellectual property rights or privacy rights;
• Your violation of any applicable law or regulation;
• Any content you submit or transmit through the Service.

10. Termination

We may suspend or terminate your access to the Service, with or without notice, for any reason, including if we believe you have violated these Terms, at our sole discretion.

You may terminate your use of the Service at any time by ceasing to use it and, if you have an account, by requesting account deletion at privacy@bashweather.app.

Upon termination:

• Your right to use the Service will immediately cease;
• We will delete your account data in accordance with our Privacy Policy;
• Provisions of these Terms that by their nature should survive termination will remain in effect, including but not limited to Sections 6 (Intellectual Property), 8 (Limitation of Liability), 9 (Indemnification), 11 (Governing Law), and 12 (Dispute Resolution).

11. Governing Law

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Hashemite Kingdom of Jordan, without regard to its conflict of law principles.

Where mandatory consumer protection or data protection laws of your country of residence provide you with greater rights, those rights are not excluded or limited by this clause.

12. Dispute Resolution

In the event of any dispute, controversy, or claim arising out of or relating to these Terms or the Service, the parties shall first attempt to resolve the matter through good-faith negotiation. Either party may initiate this process by sending written notice to the other party describing the dispute in reasonable detail.

If the dispute is not resolved within 30 days of the initial written notice, either party may submit the dispute to the courts of competent jurisdiction in the Hashemite Kingdom of Jordan.

For EU consumers: Nothing in this clause prevents you from bringing a claim before the courts of your country of residence under applicable EU consumer protection law, or from using an Alternative Dispute Resolution (ADR) body. A list of ADR bodies is available through the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

For US consumers: If you are a US consumer, the Federal Arbitration Act and applicable state law may provide you with additional rights. Nothing in these Terms is intended to limit rights you may have under applicable consumer protection law.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page. For significant changes, we may provide additional notice through the Service or by email to registered users.

Your continued use of the Service after any changes take effect constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service.

We recommend that you review these Terms periodically. The current version of the Terms is always available at bashweather.app/terms.
